Kansas District Court Public Access Portal User Agreement



Courts finished with paper backlogs

All courts affected by the October 12 cybersecurity incident have finished updating the Kansas eCourt case management system with new cases and documents filed while the system was offline. Information in the Kansas District Court Public Access Portal is now up to date. 

The Status of District Court Restoration page now shows all courts have finished working through their paper backlogs. 


Overview and terminology 

Electronic access to court information is restricted by federal and state law in addition to court rules and orders. Information on this site (the “Site”) is made available as a public service pursuant to Kansas Supreme Court Rule 22.  

The Kansas District Court Public Access Portal ("Portal”) can provide remote access to open court record information to the general public.  

A user account must be established to access the Portal. Any person or entity that accesses the Portal through a user account is a “User” under this Portal User Agreement (“Agreement”).  

The Portal is administered by the Kansas Supreme Court Office of Judicial Administration (“OJA”).  

Information displayed on the Site is not to be considered or used as an official court record and may contain errors or omissions. Accuracy of the information is not warranted. Official records of court proceedings may be obtained only directly from the court maintaining such official records.  

 

Username and password protection 

A username and password are required for use of the Portal and to set up a user account.  The User agrees not to share the username and password with anyone.  The User understands and acknowledges that the User is responsible for all use or activity on that account, including use of the account by any third party, whether authorized by User or not.  The User agrees to protect the security of its password and to notify OJA immediately by emailing ProdPortal@kscourts.org if the User suspects the username or password may have been compromised.

   

Prohibited uses 

User agrees to use the Portal only as permitted by applicable local, state, and federal laws. User specifically agrees not to:  

  1. knowingly alter, damage, or destroy the Portal or another User's computer system, network, software, program, documentation or data contained therein;  

  2. use any list of names or addresses contained in or derived from the records or information in the Portal for the purpose of selling or offering for sale any property or service to any person listed or to any person who resides at any address listed;  

  3. sell, give or otherwise make available to any person any list of names or addresses contained in or derived from the records or information in the Portal for the purpose of allowing that person to sell or offer for sale any property or service to any person listed or to any person who resides at any address listed;  

  4. use any device, software or routine to interfere or attempt to interfere with the proper working of the Portal or any activity being conducted on the Portal;  

  5. attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or making up the Portal; or 

  6. use or attempt to use spiders, robots, avatars, intelligent agents, or any other extraction or navigation search except for a normal browser.  

If a User engages in a use prohibited above or otherwise engages in a fraudulent, abusive, disruptive or illegal activity, OJA may terminate the User’s account, at OJA’s sole discretion, without notice to User. OJA may also report User’s activity to appropriate law enforcement agencies and take any other action that may be permissible under law.

 

Search limitation 

A User is limited to performing 500 or fewer searches between the hours of 12:00 a.m. and 11:59 p.m. each day, Central Time. If a User exceeds this limitation, OJA will disable the User’s account. If a User account is disabled for this reason, a User may request account reinstatement one time by contacting ProdPortal@kscourts.org. If a User’s account is disabled more than one time due to a violation of this search limitation, the account will be permanently disabled.  

 

Domain restrictions 

OJA reserves the right to block new account registration from any domain that generates any User accounts that have been disabled for violations of this Agreement.   

 

Warnings and limitation of liability 

THE INFORMATION PROVIDED ON AND OBTAINED FROM THE PORTAL DOES NOT CONSTITUTE AN OFFICIAL RECORD OF THE COURT. This information is provided as a service to the general public and is subject to change without notice. The information is provided "AS IS" without warranty of any kind, implied, express, or statutory, including but not limited to the warranties of non-infringement of third-party rights, merchantability, fitness for a particular purpose, and freedom from computer virus. OJA does not guarantee the accuracy, completeness, adequacy, or availability of the information on this website, and expressly disclaims liability for the information, including errors or omissions. The User assumes full risk and responsibility that the information provided may not meet their needs and requirements. OJA shall not be liable for any demand or claim, regardless of form of action, arising out of or incident to the posting of information or data on the Portal, the accessing or use of any information or data on the Portal, or the acts or omissions of any User or other person accessing or using any information from the Portal. 

 

Jurisdiction 

This Agreement shall be subject to, governed by, and construed according to the laws of the State of Kansas, and jurisdiction and venue of any suit in connection with this Agreement shall reside only in courts located in the State of Kansas.  

 

Severability 

If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Agreement shall continue in effect. 

 

Assignment 

This Agreement may not be assigned by User to another party without the prior express written consent of OJA.

 

Entire agreement  

This Agreement constitutes the entire agreement between the User and OJA with respect to Portal and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the User and OJA with respect to the Portal. OJA may amend this Agreement by posting such amendment (or an amended agreement) on the Portal. User’s use of its account after such amendment constitutes User’s acceptance of all changes included in such amendment or amended agreement. 

 

Consent to conditions 

Use of the Portal is conditioned on acceptance of the terms, conditions, and notices contained herein without modification.  User access and use of this site constitutes acceptance of these terms and conditions.  The User understands that this User Agreement may be amended in writing by OJA and that by consenting to continued use the User accepts those terms and conditions.
